About these terms
These terms apply to anyone using https://developmentbyniaz.com and to anyone engaging Development by Niaz for web development, app development, ui/ux design, seo, social media & ads, maintenance & support and related services. By using the site or asking us to quote, you accept them.
Using this site
You may browse, read and share this site freely. Please do not:
- copy the site, its design or its code as your own, or use it to build a competing business;
- attempt to break into, probe or overload the site, or interfere with anyone else's use of it;
- scrape the site at scale or for a dataset, without asking us first;
- submit anything unlawful, or anyone else's personal information without their permission.
We try to keep the site accurate and available but do not promise it will never be down or that every word will always be current.
Your content
You keep every right you already had in the text, images, logos, code and materials you send us. We claim no ownership of them.
You give us permission to store what you send us in order to do the work and reply to you, and to use it as a reference within our studio. We will not publish it or use it to train anything, commercially or otherwise, without asking you first. See the Privacy Policy for the detail.
Our content
The written copy, design, code, illustrations and brand assets on this site belong to Development by Niaz unless stated otherwise. You may quote a short extract with a link back. You may not republish substantial parts, or reuse the design or code, without written permission.
Any client logo shown on this site remains the client's property. It appears with their involvement as a reference for work we did, not as a trademark claim. If you would prefer yours removed, ask and we will take it down.
Case studies and client names
Projects on this site were built by us. Where we describe what was done on a site, those are our own account of our own work. Any figures, results or outcomes are indicative of that project and are not a promise about what a future project will achieve.
Client names and logos are used with permission. We are happy to remove any of them on request.
Quotes, prices and proposals
A figure on this site, or in an email, is an invitation to start a conversation — not a quotation. A quotation only becomes binding when it is written out and accepted by both sides.
What governs a project is the signed proposal or contract: scope, timeline, payment schedule, what counts as a change, and what happens either way if it ends. If that document and this page disagree, the document wins.
Taking on a project
We take on a limited number of projects at a time, and start once a proposal is accepted, a deposit is received and the required materials arrive. Delays in receiving content are not delays on our side for the purposes of a deadline.
We may decline work, or decline a part of it, where we think we cannot do it well, or where it would not be a good fit for the studio. We will say so plainly rather than take it on and deliver badly.
Changes to these terms
These terms may change as the site or the business does. The version in force is the one published here when you use the site or accept a quote, and we will update the review date at the top when we do.
Liability
We take reasonable care over this site and our work, but we do not promise it will be uninterrupted or that everything on it will always be accurate. To the fullest extent the law allows, we are not liable for loss arising from your use of this site, or from relying on general information on it without taking advice specific to your situation.
Nothing here excludes or limits liability that cannot lawfully be excluded — for fraud, for injury caused by negligence, or for anything a consumer protection law gives you regardless of what we agree.
Governing law
These terms are governed by the laws of Pakistan, and the courts of Pakistan have jurisdiction over any dispute arising from them or from a project, save where a client agreement names a different forum.
If you are a consumer outside Pakistan, this does not take away rights you have under the mandatory consumer law where you live.
